Terms of Service

Welcome to FutureApe! These Terms of Service (“Terms”) govern your use of the FutureApe mobile app and website (together, the “Service”). By using the Service, you agree to these Terms.

FutureApe is a simulation game that uses real market prices with virtual currency. No real money is used in the app, and nothing inside the app has real-world monetary value.

1) What FutureApe Is (Simulation Only)

• FutureApe is an educational, competitive trading simulation.
• You trade using virtual balances against real market prices.
• In‑app currency, items, boosts, scores, and rankings have no cash value, cannot be exchanged for real currency, and cannot be transferred or sold.
• FutureApe is not a broker, advisor, exchange, or wallet and does not provide investment services or financial advice.

2) Eligibility

• You must be at least 13 years old to use the Service. If you are under the age of majority in your jurisdiction, you must have parent/guardian permission.
• You may use the Service only in jurisdictions where it is lawful for you to do so.

3) Accounts and Access

• You may create an account using supported sign‑in providers (e.g., Sign in with Apple).
• You’re responsible for the security of your device and account. Notify us of unauthorized access promptly.
• We may suspend or terminate accounts to protect users, maintain fair play, or comply with law.

4) Virtual Currency and Items

• You receive an initial virtual balance (for example, $10,000) for gameplay.
• Virtual currency and items are digital features licensed to you; they are not personal property.
• We may add, remove, balance, or modify virtual features at any time to improve gameplay.

5) Leagues, Brackets, Scores, and Boosts

• Leagues may have different rules, themes, and eligibility.
• Brackets group players by stake/skill to keep competition fair.
• Scores (0–100) reflect factors such as return, deployment discipline, and consistency.
• Boosts and daily trade limits are gameplay mechanics and may change for balance.

6) Market Data

• Market prices and related data are provided by third‑party sources and may be delayed or inaccurate.
• You may not copy, scrape, redistribute, or commercialize market data.
• We do not guarantee the availability, accuracy, or completeness of market data.

7) Fair Play and Prohibited Conduct

To keep play fair for everyone, you agree not to:

• Cheat, exploit bugs, automate gameplay, or use unauthorized tools/bots.
• Create multiple accounts to manipulate rankings or rewards.
• Harass other users, post unlawful content, or impersonate others.
• Reverse engineer, interfere with, or disrupt the Service or its security.
• Scrape data, rate‑limit dodge, or overload our systems.

We may review and take action (including suspension or reset of scores) to protect fair play.

8) User Content and Community Rules

• You’re responsible for Your Content (handles, avatars, posts). Do not post illegal, infringing, hateful, or harmful material.
• We may remove or restrict content that violates these Terms or the spirit of fair play.
• By posting content, you grant us a non‑exclusive, worldwide, royalty‑free license to use, display, and distribute it solely for operating, improving, and promoting the Service.

9) Ownership and License

• We (or our licensors) own the Service, including software, designs, branding, and content.
• We grant you a limited, personal, non‑transferable license to use the Service for its intended purpose, subject to these Terms.

10) Feedback

If you submit feedback or ideas, you grant us permission to use them without obligation or compensation.

11) Disclaimers

• The Service is provided “AS IS” and “AS AVAILABLE.”
• We disclaim warranties of merchantability, fitness for a particular purpose, and non‑infringement.
• We do not provide investment advice. Any educational content is for learning and entertainment only.

12) Limitation of Liability

To the fullest extent permitted by law, FutureApe and its affiliates will not be liable for indirect, incidental, special, consequential, or exemplary damages, or for lost profits, data, or goodwill. Our total liability will not exceed the greater of (a) amounts you paid us (if any) in the 12 months before the claim, or (b) USD $50.

13) Indemnity

You agree to defend, indemnify, and hold harmless FutureApe and its affiliates from claims arising from your misuse of the Service or violation of these Terms.

14) Termination

We may suspend or terminate your access at any time for any reason, including violations of these Terms or fair‑play rules. You may stop using the Service at any time.

15) Governing Law and Dispute Resolution

• These Terms are governed by the laws of your domicile or, if you’re in the U.S., the laws of the State of California, excluding its conflict‑of‑law rules.
• If you are in the U.S.: You and FutureApe agree to resolve disputes through binding arbitration on an individual basis, and waive class actions, except where prohibited by law. Small‑claims court remains an option.
• If a provision is unenforceable, the remainder remains in effect.

16) Changes to the Service and Terms

We may update the Service and these Terms from time to time. Material changes will be posted with a new “Last updated” date and, where required, we’ll notify you in‑app or by other reasonable means.
